मनुस्मृति - दण्ड

सर्वो दण्डजितो लोके दुर्लभो हि शुचिर्नरः ।
दण्डस्य हि भयात्सर्वं जगत्भोगाय कल्पते ॥

Order is preserved in this world by punishment. It is very rare to find people who are clean by themselves. Punishment preserves the order so that we can enjoy fearlessly in this world.

मनु स्मृति - यमव्रतम्

यथा यमः प्रियद्वेषौ प्राप्ते काले नियच्छति ।
तथा राज्ञा नियंतव्याः प्रजास्तद्धि यमव्रतम् ॥

- मनु स्मृति

A king must punish the guilty even if they are his own relatives. Much similar to the way how Yama (Death) takes away a person as soon as his time is over. This penance of impartiality expected from a King is known as Yamavrata (penance of Yama).

मनुस्मृति - दण्ड

दण्डः शास्ति प्रजाः सर्वाः दण्ड एवाभिरक्षति ।
दण्डः सुप्तेषु जागर्ति दण्डं धर्मं विदुर्बुधाः ॥

- मनुस्मृति

Punishment is what helps the king rule his subjects justly. It protects all the subjects (from miscreants). It protects even those who are sleeping (from thieves). Hence the wise men think that punishment is an integral part of Dharma (moral code of life)

याज्ञवल्क्य - दण्ड

ज्ञात्वाऽपराधं देशं च कालं बलमथापि वा ।
वयः कर्म च वित्तं च दण्डं दण्ड्येषु पातयेत् ॥

- याज्ञवल्क्य

A king must consider all the following to give appropriate punishment for a crime - nature of the crime, place where it happened, time when it happened, strength of the perpetrator, his age, his occupation, his financial status. Only then will it be just.

पञ्चतंत्र - मित्रभेद - साम दण्ड

साम्नैव यत्र सिद्धिः न तत्र दण्डो बुधेन विनियोज्यः |
पित्तं यदि शर्करया शाम्यति कोऽर्थः पटोलेन ||

What can be got by exercising reasonable patience must never be escalated to a full fledged conflict. The wise men know this. Sour sensation in the mouth can be mitigated by eating sugar. Why would one resort to bitter-gourd instead?

पञ्चतंत्र - मित्रभेद - दण्ड

सामादिदण्डपर्यन्तो नयः प्रोक्तः स्वयंभुवा |
तेषां दण्डस्तु पापीयान् तं पश्चाद्विनियोजयेत् ||

- पञ्चतंत्र, मित्रभेद

The creator (of the world) has enumerated many ways deal with adversaries - starting from patience to punishment. Among them punishing/penalizing some one has some sin attached to it. Hence one must resort to punishment only as a last resort.

रामायण - किष्किन्धा - राजा

राजभिर्धृतदण्डास्तु कृत्वा पापानि मानवाः |
निर्मलाः स्वर्गमायान्ति सन्तः सुकृतिनो यथा ||

If a sinner gets the right punishment (from a king) then he becomes pure again. He shall go to heaven just like people who have always done only good work.

मनुस्मृति - दण्डः

यदि न प्रणयेद्राजा दण्डं दण्डेष्व तंद्रितः |
शूले मत्स्यानि वापक्ष्यन् दुर्बलान् बलवत्तराः ||

If a king is not vigilant enough to punish the guilty then the mighty will destroy the weak as if they are fish to be eaten.

कामन्दकीय - दंडाभाव

परस्परामिषतया जगतो भिन्नवर्त्मनः |
दंडाभावे परिध्वंसी मात्स्यो न्यायः प्रवर्तते ||

In the absence of punishment people who hate each other (think differently) will destroy each other. When such a social order exists (like in fish - big fish eat small fish) then the weak will suffer.

मनुस्मृति - दक्षराजः

न मित्रकारणाद्राजा विपुलाद्वा धनागमात् |
समुत्सृजेत्साहसिकान् सर्वभूतभयावहान् ||

A king must always punish people who cause fear in other people using their friends (influence), lot of money, ill gotten wealth.

मनुस्मृति - राजा

अदण्ड्यान् दण्डयन् राजा दंड्यांश्चैवाप्यदण्डयन् |
अयशो महदाप्नोति नरकं चैव गच्छति ||

- मनुस्मृति

If a king punishes the innocent and fails to punish the guilty, he will become very infamous. In addition to that, he will go to hell.

याज्ञवल्क्य - वणिजानां कपटसूत्र

संभूय वणिजां पण्यं अनर्घेणोपरुन्धताम् |
विक्रीणतां वा विहितो दन्ड उत्तम साहसः ||

If all the vendors get together and hoard merchandise to create artificial scarcity so that they can sell them at higher price, then all of them must be punished.

भेषजस्नेहलवणगन्धधान्यगुडादिषु |
पण्येषु प्रक्षिपन् हीनं पणान् दाप्यस्तु षोडश ||

- याज्ञवल्क्य

If a miser shopkeeper is adulterating medicine, oil, salt, sandal wood paste (perfume), cereals, jaggery and other such house hold items then he must be fined sixteen times the value of what he sold.

याज्ञवल्क्य - तरुहानि दमः

प्ररोहिशाखिनां शाखास्कन्दसर्वविदारणे |
उपजीव्यद्रुमाणां च विंशतेर्द्विगुणो दमः ||

- याज्ञवल्क्य

One must be punished severely if he cuts the branches and trunk of a tree that was growing well (freely and happily). The punishment must be doubled if the tree was being useful to people.
